Delaware murder suspect denied bail, defense to file insanity plea

DELAWARE, Ohio (WSYX/WTTE) -- A Delaware man accused of killing his ex's boyfriend has been denied bail.

Bryan Pemberton had his attorney's request rejected by a Delaware County Commons Pleas Court judge Monday afternoon.

“We believe Pemberton is a danger to the community and to his ex-girlfriend,” said Delaware County Prosecutor Carol O’Brien. “As such, we requested bond be denied in his case, and that he remain behind bars until trial.”

Pemberton was charged with aggravated murder of 28-year-old Ali Al Azirjawi of Hilliard. Al Azirjawi had driven his fiancée, Catherine “Abby” Scherler to Pemberton’s home in order to pick up her daughter when he was shot and killed outside the house, police said.

Pemberton entered a not guilty plea in court today. His attorney indicated he will be filing a motion to enter a not guilty by insanity plea.

A trial date was set for April 24, 2018.
